Regulations of the Tariff (price) Council of the Republic of Azerbaijan
I. General provisions
1.1. The Tariff (price) Council of the Republic of Azerbaijan (hereinafter referred to as the “Council”) is the collegial executive body which conducts state regulation of prices (tariffs), service fees, charges (hereinafter referred to as the “price”) subject to state regulation.
1.2. The Council in its activity is directed by the Constitution of the Republic of Azerbaijan, laws of the Republic of Azerbaijan, decrees and instructive orders of the president of the Republic of Azerbaijan, resolutions and instructive orders of the Cabinet of Ministers of the Republic of Azerbaijan, international treaties to which Azerbaijan is a party and this Regulations.
1.3. The Council carries out its activities in cooperation with central and local executive bodies, economic entities, local self-government bodies and public organizations.
II. Duties of the Council
2.1. Main duties of the Council are the following:
2.1.1. to ensure regulation of the prices subject to state regulation in accordance with the effective legislation of the Republic of Azerbaijan;
2.1.2. to adopt relevant documents on price regulation (choosing method of price regulation, discussing and considering proposals, preparation, approval, application and amendment of drafts etc.);
2.1.3. to improve legislative and normative legal basis of state regulation of prices, to form prices and tariffs, to give proposals on strengthening of state control of their application;
2.1.4. to adopt decision on suspension of application of prices levied through violation of the effective legislation, to give proposals on application of fines and sanctions in this area;
2.1.5. to make proposals on lessening of expenses having significant impact on regulated prices;
2.1.6. to make comments on regulated prices and carry out other measures;
2.1.7. to make proposals to the relevant bodies on additions and amendments to the list of products (works and services) of monopolistic entities subject to state regulation;
2.1.8. to make proposals on price preferences for various consumer groups, enterprises and organizations, investors as well as on determination of limits and norms;
2.1.9. to inform mass media on importance, purpose and possible outcomes of the work on state regulation of prices;
2.1.10. to represent the Republic of Azerbaijan in international and regional organizations, scientific and practical conferences and seminars on state regulation of prices;
2.1.11. to carry out other duties according to law.
III. Rights of the Council
3.1. The Council has the following rights in order perform its duties:
3.1.1. to acquire in accordance with the approved work plan necessary documents and information on cases in the authority of the Council from state bodies, enterprises and organizations irrespective of the property form;
3.1.2. to invite experts and consultants to the meetings of the Council and Council’s Secretariat in connection with the cases being considered and take other measures;
3.1.3. to monitor implementation of the decisions of the Council and take necessary measures to eliminate negative cases;
3.1.4. to adopt decisions on suspension and prolongation of decisions of the Council;
3.1.5. to conduct researches and analyses for determination of the economic reasonableness, rationality of prices, and their optimality from the point of market demands and purchasing capacity of population;
3.1.6. to establish commissions and working groups in order to increase effectiveness of the Council’s activity and to carry out prompt regulatory measures;
3.1.7. to enjoy other rights provided for in the legislation.
IV. Organization of the work of the Council
4.1. Chairman and members of the Council shall be representatives of central executive bodies appointed by the President of the Republic of Azerbaijan;
4.2. The Chairman of the Council carries out the following duties:
4.2.1. determines current and perspective directions of work of the Council’, approves and implements its work program;
4.2.2. signs methodic documents, acts, orders, instructions, letters and other documents related to the work of the Council;
4.2.3. creates relevant working groups related to the work of the Council;
4.2.4. carries out other works related to the organization of the work of the Council.
4.3. Members of the Council have the following rights and duties:
4.3.1. to participate in the work and meetings of the Council;
4.3.2. to give proposals on the agenda of the meetings of the Council and issues included in the agenda;
4.3.3. to carry out other tasks related to the work of the Council.
4.4. Secretariat of the Council is created for the organization of the work of the Council
4.5. The Chairman of the Council approves the structure of the Secretariat, regulations on its work and appoints dismisses its head.
4.6. Secretariat of the Council:
4.6.1. forms working groups of the Secretariat consisting of specialists form relevant executive bodies, enterprises and organizations and independent experts;
4.6.2. raises the issue of substitution of a member of a workings group before the body which he/she represents if such member of do not participate in the three successive meetings of the working group (without a grounded reason);
4.6.3. prepares yearly work plan of the Council and drafts of issues to be discussed at the meetings;
4.6.4. receives proposals, opinions and information on the issues that ate being considered from relevant state bodies, enterprises and organizations irrespective of the property legal-organizational form;
4.6.5. the Secretariat of the Council has a seal, stamps, letterheads with its title and State Emblem of the Republic of Azerbaijan and its own bank account.
4.7. The employees of the Secretariat are considered state employees.
4.8. The Council approves rules on consideration of the drafts and proposals, discussion of the agenda and registration of the adopted decisions.
4.9. Documents included in the agenda of the Council are presented to the Council members and considered at the Council meeting within 5 days, or, in emergency cases, within 2 days.
4.10. Meetings of the Council are held in the following order:
4.10.1. Meetings of the Council are valid only if three forth of its members participate;
4.10.2. Meetings of the Council shall be held at least once per quarter, or if necessary upon the request of the Council members;
4.10.3. Voting at the Council meetings shall be open and decisions shall be adopted by simple majority. In case of a tie, the Chairman of the Council shall have the casting vote;
4.10.4. Decisions adopted at the meetings of the council are registered in the minutes and signed by the Chairman and members of the Council;
4.10.5. Issues included in the agenda of the Council are considered according to the work plan approved by the Council;
4.10.6. Chairman, Secretary or a member of the Council reports on the issues included in the agenda of the Council;
4.10.7. Regulations for each meeting of the Council are determined, depending on the issues to be discussed, by the Chairman of the Council taking into consideration opinions of its members.
4.11.Prices (tariffs) of goods (works, services) are approved by the Council. Coming into force of the prices (tariffs) approved (or amended) by the Council shall, if necessary, be accorded with the provisions of the Law of the Republic of Azerbaijan on state budget for the relevant year.
4.12. Experts and consultants have the right only to give proposals and opinions on relevant issues.
4.13. Information on the issues considered at the meetings of the Council is disseminated Chairman or upon his consent by the Secretariat by means of mass media or the internet site of the Council.
4.14. Reorganization and liquidation of the Council is carried out by the President of the Republic of Azerbaijan.
